Welcome to Combat Clarity. The terms “we”, “us”, and “our” refer to Combat Clarity. We operate this store and website, including all related information, content, features, tools, products, and services (the “Services”). The Services are powered by Shopify.
By visiting, interacting with, or using the Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Services.

SECTION 1. ACCESS AND ACCOUNT
You represent that you are at least 18 years old or the age of majority in your jurisdiction. You agree to provide accurate and current information and to keep your credentials secure. You are responsible for all activity under your account.

We make reasonable efforts to display product information accurately. Colours and appearance can vary by device. Product descriptions and availability may change without notice. We may limit quantities for any person or region.

SECTION 3. ORDERS
Your order is an offer to buy. We may accept or reject any order at our discretion. An order is accepted when we confirm acceptance and process payment. Review your order carefully before submitting. Purchases are for personal use, not resale or export. Your purchases are subject to our Refund Policy.

Prices, discounts, and promotions may change without notice. The price charged is the price at checkout. Unless stated otherwise, prices exclude taxes, shipping, and import duties. You agree to provide current and accurate payment details and authorise us to charge your selected payment method.

SECTION 5. SHIPPING AND DELIVERY
Delivery timeframes are estimates only. We are not responsible for delays caused by carriers or events outside our control. For consumers in Australia, title and risk in goods pass to you on delivery to your nominated address. For international orders, title and risk may pass on shipment subject to applicable law. You are responsible for any customs, duties, or import fees for international shipments.

SECTION 6. HEALTH AND SAFETY DISCLAIMER
Combat Clarity supplements are food products. They are not medicines and are not intended to diagnose, treat, cure, or prevent any disease. Individual results vary. No specific performance, health, or medical outcomes are guaranteed.
Use only as directed on the label. Do not exceed the recommended daily intake. Consult a qualified healthcare professional before use, especially if you are under 18, pregnant or nursing, have a medical condition, or are taking any medication. Discontinue use and seek medical advice if you experience any adverse reaction. Keep out of reach of children.

SECTION 7. INTELLECTUAL PROPERTY
All trademarks, logos, text, images, graphics, videos, and other content on the Services are owned by Combat Clarity or its licensors and are protected by law. You may use the Services for personal, non-commercial purposes only. No rights are granted except as expressly stated.

SECTION 8. OPTIONAL TOOLS
We may provide access to third-party tools on an “as is” and “as available” basis. Your use is at your own risk. We have no liability arising from third-party tools.

The Services may contain links to third-party sites. We do not control or endorse these sites and are not responsible for their content or practices. Review their policies before engaging in any transaction.

SECTION 10. RELATIONSHIP WITH SHOPIFY
Combat Clarity is powered by Shopify. Sales are made by Combat Clarity, not by Shopify. You agree that Shopify is not responsible for your purchases or for any injury, damage, or loss related to them. You release Shopify and its affiliates from claims arising from your transactions with Combat Clarity.

SECTION 11. PRIVACY
Your personal information is collected and used in accordance with our Privacy Policy. Because we are hosted by Shopify, Shopify will also process your personal information to operate and improve the Services. See Shopify’s privacy documentation and our Privacy Policy for details.

SECTION 12. FEEDBACK AND REVIEWS
If you submit reviews, ideas, or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use and display it for any purpose. You confirm you have rights to the Feedback and that any incentives have been disclosed. We may moderate or remove Feedback that violates these Terms or the law. Do not post false, misleading, defamatory, obscene, or infringing content.

SECTION 13. ERRORS, INACCURACIES, AND OMISSIONS
Information on the Services may contain errors or omissions, including pricing and availability. We may correct or update information or cancel orders if information is inaccurate, including after you have submitted an order.

You may use the Services only for lawful purposes. You must not violate laws, infringe intellectual property, harass or harm others, submit misleading information, distribute malware, bypass security, scrape, or attempt to disrupt the Services. We may suspend or terminate access for violations.

SECTION 15. RETURNS, REFUNDS, AND EXCHANGES
Returns and refunds are handled in accordance with our Refund Policy. For safety and hygiene reasons, opened or used supplements are not returnable unless required by law. This section incorporates the Australian Consumer Law summary in Section 16.

SECTION 16. AUSTRALIAN CONSUMER LAW
Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies you have under the Australian Consumer Law. Where legislation implies warranties or guarantees that cannot be excluded, our liability is limited, to the extent permitted by law, to the replacement of the goods, the supply of equivalent goods, or the cost of doing so.

SECTION 17. DISCLAIMER OF WARRANTIES
Except for non-excludable guarantees under the Australian Consumer Law, the Services and all products are provided on an “as is” and “as available” basis. We do not warrant that the Services will be uninterrupted or error free, or that the information is accurate or complete. To the extent permitted by law, we disclaim all other warranties, including implied warranties of merchantability and fitness for a particular purpose.

SECTION 18. LIMITATION OF LIABILITY
To the fullest extent permitted by law and subject to Section 16, we are not liable for indirect, incidental, special, consequential, or punitive damages, loss of profits, loss of data, or replacement costs arising from or related to your use of the Services or products. For any liability that cannot be excluded, our total aggregate liability is limited to the amount you paid for the product that gave rise to the claim.

SECTION 19. INDEMNIFICATION
You agree to indemnify and hold harmless Combat Clarity and our officers, directors, employees, agents, contractors, and service providers from losses, damages, and expenses arising from your breach of these Terms or your unlawful use of the Services.

SECTION 20. SEVERABILITY
If any provision of these Terms is unlawful or unenforceable, it will be enforced to the maximum extent permitted and the remainder will continue in full force.

SECTION 21. WAIVER AND ENTIRE AGREEMENT
Our failure to enforce any right is not a waiver. These Terms, together with policies posted on the Services, are the entire agreement between you and us regarding the Services.

SECTION 22. ASSIGNMENT
You may not assign your rights or obligations without our prior written consent. We may assign these Terms without notice.

SECTION 23. GOVERNING LAW
These Terms are governed by the laws of South Australia and the laws of the Commonwealth of Australia. You and Combat Clarity submit to the non-exclusive jurisdiction of the courts of South Australia and the Federal Court of Australia.

SECTION 24. CHANGES TO TERMS
We may update these Terms by posting a new version on the site. Material changes will be notified in accordance with applicable law. Continued use of the Services after changes take effect constitutes acceptance.
